1.1 Timber and Hide is a trading division of SMD Technologies, registration number 2015/107801/07 and VAT number 4580237602. These Terms apply to your use of our website and govern the sale of products to you.
1.2 By visiting our site or placing an order you agree to be bound by these Terms. If you do not agree, you must not use the website.
2. USE OF THE WEBSITE
2.1 You may use our website for lawful purposes only. You may view, download and print content for your own personal, non‑commercial use. You may not copy, reproduce, distribute or exploit our content for commercial purposes without our written permission.
2.2 You must not upload or transmit any unlawful, harmful, threatening, abusive, defamatory, obscene or racially offensive material. If you breach this clause we may suspend or terminate your access without notice.
2.3 You are responsible for keeping your login credentials confidential and for all activities under your account. You may not impersonate another user or provide false information.
3. CHANGES TO THE WEBSITE AND TERMS
3.1 We may modify, add to or remove these Terms at any time. Updated Terms will take effect when posted on the website. Your continued use after a change is posted constitutes acceptance of the updated Terms.
3.2 We may suspend, modify or discontinue the website, or any part of it, without notice. We will not be liable for any such suspension or discontinuance.
4. INTELLECTUAL PROPERTY
4.1 All content on our website, including text, images, logos, product names and descriptions, is owned by us. Unauthorised copying, downloading, scraping or commercial use is prohibited.
4.2 You may not use our product names, images or descriptions on third‑party platforms or in unauthorised sales listings. Resale of our products on third‑party marketplaces is permitted only with our written consent.
5. PRICES, COLOURS AND AVAILABILITY
5.1 All prices on our website are quoted in South African Rand inclusive of VAT. Prices may change without notice. We reserve the right to correct obvious pricing errors and to cancel orders placed at an incorrect price.
5.2 Product images are illustrative and colours may differ depending on your screen. We cannot guarantee that your monitor’s display of any colour will be accurate.
5.3 Displaying a product on our website does not guarantee its availability. Stock levels vary and some items may not be available when you order.
6. ACCURACY OF INFORMATION
6.1 We take reasonable steps to ensure that information on the website is accurate and up to date, but errors may occur. If a price or delivery fee is displayed incorrectly, we will contact you to confirm the correct amount. If you choose not to proceed at the corrected price, we will refund any payment you have made.
7. EXCLUSIONS AND PRODUCT DESCRIPTION
7.1 Accessories and decorative items shown in our images are excluded unless expressly stated.
7.2 Many items may require minor assembly by the customer. Assembly instructions are included with the product. We do not offer an assembly service and accept no liability for damage incurred during self‑assembly.
7.3 Delivery charges and any applicable fees are excluded from the product price and will be calculated at checkout.
8. ORDERING AND FORMATION OF CONTRACT
8.1 Placing items in your cart does not constitute a contract. A binding agreement is formed only once you complete payment and we accept your order.
8.2 We reserve the right to decline or limit orders at our discretion. Goods remain our property until paid for in full.
8.3 Orders must be placed through our website. We do not accept orders by telephone or email.
9. PAYMENT
9.1 We accept payment by credit or debit card via our secure payment gateway. We do not accept electronic funds transfers, cash payments or telephonic orders.
9.2 We may request additional verification to validate your payment details. Dispatch may be delayed until payment has been confirmed.
10. DELIVERY
10.1 We deliver within South Africa only. Orders under R2 999 attract a flat delivery fee of R325. Orders of R2 999 or more qualify for free delivery. The final delivery charge is calculated at checkout based on your address.
10.2 Estimated delivery times are three to five working days for deliveries to major cities and five to seven working days for remote areas. Working days are Monday to Friday, excluding public holidays.
10.3 Goods are dispatched once payment is confirmed. We will contact you to arrange a delivery date and approximate time. You must ensure that the delivery address is accurate and accessible and that someone is available to sign for the goods. We are not liable for additional charges due to missed deliveries or inaccessible premises.
10.4 Risk transfers to you upon delivery. You must inspect the goods on arrival and note any visible damage on the delivery document. Hidden defects must be reported within forty eight hours of delivery. We are not responsible for damages not noted or reported within the specified periods.
10.5 We do not offer collection services. All orders will be delivered to the address provided at checkout.
11. CANCELLATIONS AND NON‑DEFECTIVE RETURNS
11.1 You may cancel your order before dispatch for a full refund. After dispatch, you may cancel within seven working days of delivery if items are unused, unassembled, complete and in their original packaging. To cancel, email returns@smdtechnologies.com with your order number, photographs of the goods and reasons for return.
11.2 A handling fee of five percent of the purchase price or R70 (whichever is greater) will be deducted from your refund. If your order qualified for free delivery, the original delivery fee and the return fee will also be deducted.
11.3 You are responsible for the cost of returning the goods. Made‑to‑order items and items that have been assembled cannot be returned. Returns must be packaged securely; you will be liable for any damages caused by inadequate packaging.
11.4 Refunds will be processed within thirty days of the cancellation date once we have inspected the goods. Quality control inspections can take up to three working days.
12. DEFECTIVE OR DAMAGED GOODS
12.1 You must inspect goods upon delivery. If there is visible damage you may refuse delivery or record it on the delivery note. For hidden defects you must notify us at returns@smdtechnologies.com within forty eight hours of delivery and include photographs and a description of the issue.
12.2 If damage is reported after forty eight hours we may determine that the damage occurred after delivery. We will decide whether to repair, replace or refund the item. We will pay for collection and delivery only if the product is confirmed defective. If the product is found not defective, you will be liable for transport costs and handling fees.
12.3 Missing parts must be reported within forty eight hours of receipt. Failure to do so may result in replacement parts or items being provided at our discretion.
13. WARRANTY
13.1 All Timber and Hide products carry a one‑year warranty from the date of delivery. The original proof of purchase is required. The warranty covers manufacturing faults only and does not cover wear and tear, misuse, negligence, accidents, modifications or products used for commercial purposes unless specified on the invoice.
13.2 We will repair or replace defective parts or the entire product at our discretion. If repair or replacement is not possible, we will offer a store credit or refund. Replacement items fall under the original warranty period.
13.3 Warranty claims must be submitted to returns@smdtechnologies.com with a description of the problem and photographs. We will respond within seventy two hours. If the product is found not to be defective, you will be responsible for transport costs and handling fees.
14. LIABILITY AND INDEMNITY
14.1 To the fullest extent permitted by law, Timber and Hide will not be liable for any direct, indirect or consequential loss or damage arising from your use of the website or the purchase of our products.
14.2 We do not warrant that the website or its server are free from viruses. You agree to indemnify us against any loss suffered because of your use of the site or your breach of these Terms.
15. PRIVACY AND SECURITY
15.1 We use secure, encrypted payment gateways and fraud detection tools to protect your personal information and payment details.
15.2 Your login name and password are for your personal use only and should not be disclosed to any third party. Attempting to deliver or upload malicious code to our website will result in prosecution and civil damages.
16. VOUCHERS AND PROMOTIONS
16.1 We may issue vouchers or promotional coupons. Vouchers are valid for the period stated and can only be used once. No residual credit will remain if the voucher value exceeds your purchase. Vouchers cannot be exchanged for cash or used to purchase other vouchers.
16.2 If the voucher value is insufficient for your purchase you may pay the difference. Delivery charges cannot be paid with vouchers.
16.3 Promotional coupons are valid only for the specified products and period and cannot be used with other promotions.
16.4 We are not liable for the loss, theft or misuse of vouchers. In cases of suspected fraud we may close your account or request another payment method.
17. BREACH AND TERMINATION
17.1 If you fail to make payment or breach any provision of these Terms and do not remedy the breach within seven days of receiving written notice, we may cancel your order and terminate your access immediately.
18. GOVERNING LAW
18.1 These Terms are governed by South African law. You consent to the jurisdiction of the South African courts for any dispute. If any provision of these Terms is held invalid, the remaining provisions remain enforceable.
